Challenge in the writ petition is to an order dated 18.1.2025 passed by the Additional District Magistrate (Finance & Revenue), Bareilly imposing penalty upon the petitioner for illegal mining of soil. 3. A preliminary objection has been raised by the learned Standing Counsel that the impugned order is appealable under Section 79 of the Uttar Pradesh Minor Minerals (Concession) Rules, 2021. 4. Learned counsel for the petitioner has not been able to dispute the existence of a statutory alternative remedy. 5. Under the circumstances, this Court declines to interfere in the matter and the writ petition is dismissed leaving it open for the petitioner to avail the statutory remedy of appeal against the order impugned for redressal of his grievance.
