1. The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.203 dated 19.12.2021 registered under Sections 326, 325, 323, 324, 427, 148, 149, 120-B of IPC (Section 307 IPC added later on), at Police Station Mahilpur, District Hoshiarpur.

Learned counsel for the petitioner contends that the petitioner was not initially named in the FIR and later on, under the political influence, he was nominated as an accused in the present case. He further contends that even otherwise, no specific role or injury has been attributed to the petitioner. Learned counsel further contends that after registration of the FIR, the investigation was conducted by five different police officials and during the investigation by four police officials, he was found to be innocent. The petitioner was arrested in the present case on 07.08.2024 and is in custody for the last about 8 months. CRM-M-18565-2025 -2- that similarly placed co-accused, namely Narinder Singh @ Ninder has already been admitted to bail by this Court.
3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court.
4. I have heard the learned counsel for the parties and perused the record.
5. The petitioner is stated to be in custody since 07.08.2024 and the challan has been presented against him. However, the prosecution has not been able to examine even a single witness so far. Similarly placed co-accused, namely Narinder Singh @ Ninder has been granted the concession of regular bail by this Court.
6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
