04/19.11.2025 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Dumri P.S. Case No.85 of 2025, registered for the offence under Sections 292 and 275 of the BNS and Section 47(a) of the Excise Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Giridih.

Learned counsel appearing for the petitioners submits that the petitioners are earning their livelihood by selling food on Thelas. She further submits that the allegations are made that beer bottles have been recovered from the Thelas. She then submits that the petitioners are having no criminal antecedents, as disclosed in paragraph 10 of this application. She next submits that the petitioners were not present there at the time of raid.

Learned counsel appearing for the State opposed the prayer and submits that illegally beer bottles were kept in the Thelas.
5. Considering that the petitioners are earning their livelihood by selling food on Thelas and they have got no criminal antecedents and at the time of raid, they were not present on the spot and in the attending facts and

circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih in connection with Dumri P.S. Case No.85 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
