Heard Shri R Saikia, learned counsel for the applicant, who by means of this application filed under Section 5 of the Limitation Act, 1963 is praying for condonation of delay of 12 days in preferring the connected writ appeal. The appeal has been preferred against the judgment and order dated 19.12.2024 passed in WP(C)/74/2019. Shri Saikia, learned counsel for the applicant by drawing the attention of this Court to the averments made in paragraph 5 of the writ petition has submitted that the delay has occurred not because of negligence or laches on the part of the applicant but for reasons which were beyond his control. Shri D Kamduk, learned counsel for the sole opposite party/writ petitioner, however, submits that he would not seriously object to the aspect of limitation and would rather, oppose the writ appeal. Considering the aforesaid submissions and also the reasons cited in paragraphs 4 and 5 of this application, we are of the view that interest of justice would require condonation of delay of 12 days in preferring the connected appeal.
