(ORAL) The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of directions to respondents No.2 & 3 to decide the representation dated 28.03.2025 (Annexure P-1). Learned counsel for the petitioner inter alia contends that during the panchayat elections, respondent No.4 was contesting for the post of Sarpanch and the petitioner was supporting a rival party. On 18.11.2024, the petitioner was travelling from Mansa to Bathinda for some work. At approximately 06:35 PM, when the petitioner reached near the water canal in Rurkee Kalan, an Ertiga car, driven by an unknown individual on behalf of respondent No.6, blocked the petitioner’s path from the front, while another Honda City car blocked his way from behind. Subsequently, respondents No.6 & 7 assaulted the petitioner by striking him with an iron rod to the back of his head with an intention to kill him and during this attack, respondent No.7 was shouting loudly that they had received instructions from respondents No.5 & 8 to ensure that petitioner does not survive today. Thereafter, respondent No.8 struck the petitioner on the head with a soti blow, while certain unidentified individuals attacked the petitioner from behind. As the petitioner collapsed to the ground, the assailants continued their assault, believing him to be dead. During the attack, they also stole an amount of Rs.50,000/- from the Neha 2025.04.03 18:05 I attest to the accuracy and integrity of this document CRM-M-18325-2025 -2- petitioner’s pocket and damaged his mobile phone. Subsequently, the petitioner submitted a representation dated 28.03.2025 (Annexure P-1), which remains pending before respondent No.2. Learned counsel for the petitioner further submits that the petitioner would be satisfied in case a direction is issued to respondent No.2 to consider and decide the representation dated 28.03.2025 (Annexure P-1) submitted by the petitioner in a time bound manner. Notice of motion to the official respondents only. Mr. Subhash Godara, Addl.A.G., Punjab, puts in appearance and accepts notice on behalf of the official respondents-State and copy of the petition has been supplied in the Court. Keeping in view the prayer made by the petitioner and without commenting anything on the merits of the case, the present petition is disposed of with a direction to respondent No.2 to consider and decide the representation dated 28.03.2025 (Annexure P-1) submitted by the petitioner and take appropriate steps including grant of any protection to the petitioner in view of the apprehension, if any, within a period of four weeks from the date of receipt of certified copy of this order, in accordance with law.
