GP FOR HOME The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondent No 2 in not taking any action and representation of the Petitioner dated 31.10.2022 for providing police protection to the Petitioner and his house property bearing No 21/620 an extent of 354 Sq.yards situated at French peta, near Suvarchala Anjaneya Swamy Temple, Machilipatnam, Krishna District for vacating the premises thorough the 3'd respondent is illegal, arbitrary and violation of principles of natural justice and consequently direct the respondent No 2 to provide police protection to the Petitioner and his house property bearing No 21/620 an extent of 354 Sq.yards situated at French peta, near Suvarchala Anjaneya Swamy Temple, Machilipatnam, Krishna District.” 2. Heard Sri K.Srinivas, learned counsel for the Petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the Petitioner would submit that the unofficial Respondents herein filed a civil suit in O.S.No.311 of 2008 on the file of the Court of Principal Senior Civil Judge, Machilipatnam against the Petitioner seeking specific performance of agreement of sale and the same was dismissed vide Judgment dated 03.04.2017. It is further submitted that the appeal in A.S.No.36 of 2017 on the file of the Court of IX Additional District and Sessions Judge, Machilipatnam against the said judgment was also dismissed. Learned counsel would further submit that the Petitioner has submitted a representation to the Police seeking police protection, since the unofficial Respondents are trying to dispossess the Petitioner from the subject property. 3 4. Learned Assistant Government Pleader for Home would submit that, since the subject matter is of civil nature, Police are not interfering with the same. 5. Learned counsel for the Petitioner, in reply, would submit that, liberty may be given to the Petitioner to make fresh representation. 6. Considering the submissions made, the Writ Petition is disposed of. However, Petitioner is at liberty to make a fresh representation to the Police, and on filing such representation, the Police are directed to look into the same and take appropriate steps in accordance with law. There shall be no order as to costs.
