THIS PETITION, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The Petitioners are before this Court seeking for the following reliefs; “Appoint an arbitrator in accordance with clause 22 of the JDA executed and entered into between the parties herein on 14.03.2019 at Annexure-A to resolve the dispute that has arisen between the parties, in the interest of justice and equity. 2. After arguing for some time, learned counsel for the Respondent submits that he has no objection to appoint an Arbitrator to adjudicate the disputes between the parties. 3. In that view of the matter, I pass the following; - 3 - HC-KAR NC: 2025:KHC:48320 CMP No. 288 of 2025 ORDER i. The CMP is allowed. ii. Hon’ble Sri. Justice P.N. Desai., a former Judge of this Court, is appointed as a sole Arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. iii. Registry is directed to forward a copy of this order to the Director, Arbitration & Conciliation Centre for doing the needful. iv. Since the order is passed in the presence of both the counsels, the counsels are directed to appear before the Director, Arbitration & Conciliation Centre without requirement of any notice at 2.30 p.m. on 09.12.2025. v. All contentions are left open. vi.
