The order of which contempt is alleged has been not complied with for the reason that the education department, where respondent No.3 is working as Deputy Director, has taken a decision to challenge the judgment. Accordingly, the Deputy Director informed the Education Officer vide communication dated 22.04.2025 that further steps cannot be taken. 3. That being so, it cannot be said that the respondents have willfully disobeyed the order. The respondents are in a process to challenge the order and they are entitled to do so. 4. In the circumstances, the petitioner cannot allege that the respondents have disobeyed the order muchless willfully. 5. The petition is accordingly dismissed. 6. In view of above, the undertaking given to this Court by respondent No.3 on 02.07.2026, need not be processed. Learned A.G.P, however, submits that if decision before the Supreme Court goes against the respondents, the amount due and payable to the petitioner will be paid, as early as possible. 7.
