3.
Learned counsel for the State has opposed the bail applica- tion and has submitted that there are six criminal antecedents registered against the accused-applicant, howsoever, they are not of akin nature. It is further submitted that the accused-applicant is a threat to the society.
4. Nevertheless, learned counsel has acknowledged that ac- cused-applicant is behind bars ever-since 18.08.2024 i.e., for a period of more than one year.
5. Heard.
6. Considering the arguments advanced by the learned counsel for the parties and considering the fact that accused is behind bars ever since 18.08.2024; that contraband recovered from the ac- cused is less than the specified commercial quantity, therefore, looking to the overall facts and circumstances, but without com- menting anything on merits/demerits of the case, this Court is in- clined to enlarge the accused-applicant on bail.
7. Accordingly, the bail application under Section 483 BNSS is hereby allowed and it is ordered that accused-applicant Surendra Kumar @ Pintu S/o Shri Richhpal shall be enlarged on bail pro- vided that he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the Court concerned on all the dates of hearing as and when called upon to do so. Furthermore, as an extended interpretation of the provisions of 'community ser- vice' as enshrined under the Bhartiya Nayay Sanhita, and as a re- formative approach to re-include the accused-applicant back in the society with a better vision, aim and zeal in life, this court deems it fit to impose an ancillary condition upon the applicant, there-
[2025:RJ-JP:40988] (3 of 3) [CRLMB-3403/2025] fore, it is directed that the accused-applicant shall contribute to the Swachh Bharat Abhiyan – initiative of the government, for a period of two months from the date of enlarging on bail, on two hours per day basis, as an honorary work, under the supervision and directions of the SHO qua the FIR (Supra) in consonance with the directions of the Municipal Corporation/Local Administrative authorities concerned.
