DATE : SEPTEMBER 02, 2026 1) In the present petitions, the judgment dated 09/04/2025, passed by the Maharashtra Administrative Tribunal, partly allowing the Original Application filed by the respondents and issuing certain directions to consider the petitioners, who are Assistant Professors, for promotion to the post of Associate Professor, is under challenge. 2) One of the grounds of challenge to the said judgment is that the post of Associate Professor is not promotional post and same is to be filled in by direct recruitment. KOLHE 2026:BHC-NAG:11566-DB 2 908-wp 3541.2025.odt 3) While countering this argument, learned counsel for the respondents have placed reliance upon AICTE Notification dated 01/03/2019 and Government Resolution dated 11/09/2019. 4) Today, learned AGP Mr. Rao has pointed out that an important Government Resolution dated 03/06/2022, clarifying the position with regard to the issue involved in the present petitions, was inadvertently not brought to the notice of the learned Tribunal. The Authorities came across the said Government Resolution, after the judgment was passed, which goes to the root of the matter. 5) In the circumstances, Mr. Rao, on instructions, seeks permission to withdraw the present petitions, with liberty to approach the Tribunal by filing review applications and thereby place on record the Government Resolution dated 03/06/2022 for consideration of the learned Tribunal. 6) Permission is granted.
