Heard submissions of learned counsel for the petitioner, learned counsel for respondent No.1 as well as learned counsel for respondent No.5. 2. The primary submission made on behalf of learned counsel for the petitioner is that if reasonable time is granted, the petitioner would voluntarily vacate the premises. It is further submitted that the petitioner does not otherwise dispute the entitlement of the respondent No.5 to take possession of the premises. 3. Learned counsel for the petitioner seeks for time upto the end of March - 2026. However, learned counsel for the respondent No.5 on instructions submits that the respondent No.5 is willing to accommodate the petitioner upto the end of January 2026. 4. In view of the aforementioned, keeping in mind the fact that the dispute between the parties is in a narrow compass i.e., as to the date of the petitioner voluntarily vacating the - 4 - HC-KAR NC: 2025:KHC:54793 WP No. 38983 of 2025 premises, it is deemed expedient that the petitioner vacates the premises on or before 15.02.2026. 5. The learned counsel for the petitioner and respondent No.5 would also submit that they would be agreeable to the said date. 6. The petitioner shall file an affidavit within two weeks from date after serving an advance copy to the learned counsel for respondent No. 5, affirming that he would voluntarily vacate the property in question on or before 15.02.2026. Respondent No.5 shall not take any precipitative action till 15.02.2026. 7. In view of the aforementioned, the writ petition is disposed of in the aforementioned terms. Sd/- (C.M.
