HEMALEKHA - 3 - HC-KAR NC: 2025:KHC:39621 WP No. 19977 of 2025 ORAL ORDER Petitioners are before this Court seeking for the following reliefs: a) Issue Writ in the nature of Mandamus or Order or Direction in the similar nature directing the 2nd and 3rd respondent authorities to consider the representation dated 15.01.2025 vide Annexure-J for release of compensation by passing Consent Award in respect of the land bearing Sy. No. 22 measuring to an extent of 02 acres 08 guntas situated at Obalapura Village, Thyamagondlu Hobli, Nelamangala Taluk, Bangalore Rural District in favour of the petitioners as per the Order dated 20.12.2024 in WP.No.35026/2024 (LA-KIADB) passed by this Hon'ble Court vide Annexure-G insofar as petitioner concerned, expeditiously; b) Grant any such relief's as this Hon'ble Court deems fit to grant in the facts and circumstances of the case in the interest of justice and equity". 2. Heard learned counsel appearing for petitioners and learned counsel appearing for respondents. 3. It is the grievance of the petitioners that, their representation dated 15.01.2025 at Annexure-J is not yet considered by the authorities. - 4 - HC-KAR NC: 2025:KHC:39621 WP No. 19977 of 2025 4. In WP.No.35026/2024 (LA-KIADB) preferred by petitioner No.4, this Court on 20.12.2024 passed the following; "ORDER i. Writ petition is allowed. ii. Impugned General Award dated 07.12.2022 (Annexure-C) passed by respondent No.2 is hereby quashed. iii. In the event of there being any claims adverse as regards the petitioner in respect of the said land prior to the disbursal of the amount, the General Award will come back automatically into force. iv. Respondent No.3 is permitted to withdraw the amount in deposit and disburse to the petitioner." 5. Pursuant to the aforesaid order, the petitioner submitted a representation dated 15.01.2025 to respondent No.3 seeking release of the compensation by passing consent Award in respect of land bearing Sy.No.22 measuring an extent of 2 acres 8 guntas situated at Obalapura Village, Thyamagondlu Hobli, Nelamangala Taluk, Bengaluru Rural District. - 5 - HC-KAR NC: 2025:KHC:39621 WP No. 19977 of 2025 6. Learned counsel appearing for respondents fairly submitted that, if some reasonable time is granted, the authorities would consider the said representation in accordance with law. 7. The said submission is placed on record. 8. In view of the submission made by learned counsel appearing for respondents, this Court pass the following ; ORDER i) The writ petition is disposed of. ii) Respondent No.3 is directed to consider the petitioners' representation dated 15.01.2025 at Annexure-J and to pass appropriate orders in accordance with law, within an outer limit of three months from today.
