Heard learned counsel Shri V.R.Choudhari for the petitioner and learned Additional Government Pleader Shri S.S.Hulke for respondent No.1. 2. The petitioner seeks directions of this court to respondent No.1 - The President/Member Secretary, Caste Scrutiny Committee for Scheduled Tribe, Gondia, District Gondia, Nagpur Division, Nagpur to decide his caste claim expeditiously. 3. The contention is that, the caste claim of the petitioner was submitted to respondent No.1 – Committee on 2.4.2024. The aforesaid caste claim is not yet decided by the Committee. 2 3 wp5626.25.odt 4. In meanwhile, employer of the petitioner, i.e. respondent No.2, has issued Notice dated 1.4.2025 thereby insisting the petitioner to submit Caste Validity Certificate, failing which necessary action shall be initiated against him. The aforesaid Notice dated 1.4.2025 is at page No.53 of the petition. In view of such termination Notice, the petitioner has approached this court. 5. Learned Assistant Government Pleader submits that respondent No.1 – Committee shall decide the caste claim of the petitioner within a period of three months from today. 6. In view of the above, we dispose of the present writ petition, as per order below: ORDER (1) The Writ Petition is disposed of. (2) Respondent No.1 - The President/Member Secretary, Caste Scrutiny Committee for Scheduled Tribe, Gondia, District Gondia, Nagpur Division, Nagpur is directed to decide the caste claim of the petitioner as belonging to “Binjhwar Scheduled Tribe” within a period of three months from today. (3) The petitioner is directed to cooperate with the Committee in expeditious disposal of his caste claim without seeking unnecessary adjournments. 3 3 wp5626.25.odt (4) In the meanwhile, respondent No.2 shall not take any coercive action against the petitioner for want of Caste Validity Certificate, till decision by the Committee.
