HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 13562/2017 Sachin Kumar Sain Son Of Shri Duli Chand Sain, Resident Of Village And Post Bharko Kalan, Tehsil Reni, District Alwar Minor Thorough Natural Guardian Father- Duli Chand Son Of Shri Ram Swaroop Sain Aged About 44 Years, Resident Of Village And Post Bharko Kalan, Tehsil Reni, District Alwar. ----Petitioner Versus 1. Union Of India Through Secretary, Ministry Of Science And Technology, Department Of Science And Tec, Technology Bhawan, New Mehrauli Road, New Delhi- 110016 2. Principal, Raj Rishi College, Alwar ----Respondents For Petitioner(s) : Mr. Ashok Yadav For Respondent(s) : Ms. Manjeet Kaur Mr. Aditya Singh, Dy.GC JUSTICE ANOOP KUMAR DHAND Order 07/07/2025 1. By way of filing this writ petition, a challenge has been led to the impugned communication dated 7.06.2017, by which the application submitted by the petitioner seeking scholarship for higher education under ‘inspire’ scheme has been rejected on the ground that the endorsement certificate was not submitted in the proper format. 2. Learned counsel for the petitioner submits that the petitioner secured distinction marks in his Senior Secondary Examination. Counsel submits that the Board of Secondary Education for Rajasthan (for short ‘the Board’) issued an (2 of 4) [CW-13562/2017] eligibility certificate in favour of the petitioner, showing him entitled for scholarship in higher education under the ‘inspire’ scheme. Counsel submits that on the basis of the said certificate, issued by the Board, the petitioner submitted an application seeking aforesaid scholarship by enclosing an endorsement certificate issued by the Principal of the concerned College. Counsel submits that in-spite of completing the required formalities, the scholarship has not been awarded to the petitioner, on the technical count that endorsement certificate was not submitted in the proper format and accordingly, his application was rejected. Counsel submits that whatever formalities were required, have been duly fulfilled by the petitioner, hence, under these circumstances, interference of this Court is warranted for issuing appropriate directions to the respondents for awarding scholarship to the petitioner, under the aforesaid scheme. 3. Per contra, learned counsel for the respondents opposed the arguments raised by the counsel for the petitioner and submitted that mere getting a certificate from the Board showing him eligible to get scholarship is not sufficient. Counsel submits that for submission of the application for getting scholarship for higher education, under the aforesaid scheme, is a mechanism which has been provided by the Ministry of Science and Technology, Department of Science and Technology, which indicates that the endorsement certificate is required to be submitted in a proper format indicating the desired information, but in the instant case, the (3 of 4) [CW-13562/2017] certificate, so furnished by the petitioner, under the signatures of the Principal of the concerned college was not indicating the studies, which the petitioner was undergoing. Counsel submits that the desired information was not furnished in the aforesaid certificate, rather the certificate was not furnished in the format, as prescribed and made available on the website. Counsel submits that in all, ten thousand students were supposed to get the aforesaid scholarship. Counsel submits that mere submission of application, on the basis of eligibility certificate, is not enough, the matter was required to be scrutinized at the subsequent stage also. Therefore, under these circumstances, the petitioner has no valid claim seeking aforesaid scholarship, hence, interference of this Court is not warranted and the writ petition is liable to be rejected. 4. Heard and considered the submissions made at the Bar and perused the material available on the record. 5. Perusal of the record indicates that a complete mechanism has been provided by the Department of Science and Technology for submission of application forms for getting the scholarship in higher education under the ‘inspire’ scheme. All the eligible candidates are supposed to submit the endorsement certificate, issued by the HOD/Principal of the concerned College, wherein, certain necessary information is required to be furnished. But in the instant case, all such information were missing in the certificate, issued by the Principal of the concerned College, in favour of the petitioner. A bare perusal of the aforesaid certificate shows that it did not (4 of 4) [CW-13562/2017] even indicate the class, in which the petitioner was studying or had taken admission for higher studies. Since, the requisite information were missing in the application format as well as in the endorsement certificate, issued by the Principal, the respondents have not caused any illegality in rejecting the application submitted by the petitioner. 6. This Court finds no merit and substance in this petition, accordingly, the same is dismissed. The stay application and all pending applications, if any, also stand dismissed.
