COMMISSIONER HINDU RELIGIOUS INSTITUTIONS AND CHARITABLE ENDOWMENT DEPARTMENT WHO IS THE R-2 HEREIN SEEKING TO DELETE THE NAME OF SHANTHANANDA VINAYAKASWAMY DEVALAYA MANAGED BY THE TRUST SHANTHANANDA VINAYAKASWAMY DEVALAYA AND DATTAGURU SHANKARA VEDANTHA NILAYA FROM THE LIST OF MUZRAI TEMPLES MENTIONED IN THE GAZETTE DTD.
29.09.2012 AS PER ANNX-F WHICH IS SITUATED IN THE LAND BEARING SY.NO. 115 (OLD SY.NO. 41) SITUATED AT ALLALASANDRA VILLAGE, YELAHANKA HOBLI, BANGALORE NORTH TALUK, MEASURING 1 ACRE 28 GUNTAS.
THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs; a. Issue writ of mandamus to consider the representation dtd. 11.06.2024 as per Annx-A made by the petitioner to the Commissioner Hindu Religious Institutions and Charitable Endowment Department who is the respondent No.2 herein seeking to Delete the name of Shanthananda Vinayakaswamy Devalaya managed by the trust Shanthananda Vinayakaswamy Devalaya and Dattaguru Shankara Vedantha Nilaya from the list of Muzrai temples mentioned in the Gazette dtd. 29.09.2012 as per Annx-F which is situated in the land bearing Sy.No. 115 (old Sy.No. 41) situated at Allalasandra Village, Yelahanka Hobli, Bangalore North Taluk, measuring 1 acre 28 guntas.
b. Issue such other order, writ or direction as may be deemed fit to grant the circumstances of the case.

2. The grievance of the petitioner is that the representation dated 11.06.2024 at Annexure-A submitted by the petitioner to respondent No.2 seeking for deletion of the temple managed by the petitioner from the list of Muzarai has not been considered. The impleading application has been filed by the Archaka of the temple contending that the same cannot be deleted.
3. Even if such obwjections were to exist on part of the impleading applicant, the representation having been submitted, it is for respondent No.2 to consider the same and pass necessary orders either accepting or rejecting the request made by the petitioner. Needless to say, if an order of rejection is passed, same would have to be accompanied by reasons. Hence, I pass the following:
ORDER i) The writ petition is allowed.

ii) Respondent No.2 is directed to consider the representation dated 11.06.2024 at Annexure-A made by the petitioner within a period of 30 days from the date of receipt of copy of this order. iii) Before passing the said order, respondent No.2 shall also afford an opportunity of hearing to the impleading applicant.
