Neutral Citation No. - 2025:AHC:84422 Court No. - 74 Case :- WRIT - C No. - 11122 of 2025 Petitioner :- Smt. Geeta Devi And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ram Badan Maurya Counsel for Respondent :- C.S.C. Hon'ble Saurabh Srivastava,J. 1. Learned Additional Chief Standing Counsel for the State has handed over a copy of the instructions, the same is taken on record. 2. Heard learned counsel for petitioners and learned Additional Chief Standing Counsel for the State-respondents. 3. By way of the present writ petition, a direction in the nature of mandamus directing the respondents not to interfere in peaceful marital life of petitioners, has been sought. 4. By bare perusal of the records, it appears that online application for seeking registration of their marriage, was applied by petitioners on dated 07.04.2025 and thereafter, no steps have been taken by petitioners for registration of the marriage in pursuance of online application preferred on dated 07.04.2025, which shows that petitioners have never intended to seek registration of their marriage for which they have applied for. 5. On last occasion, interim protection has been granted in favour of the petitioners for providing security just to ensure that between this period, the limitation for seeking registration of marriage has already been expired and now both the petitioners has to file fresh application through online which will again takes at least a month to receive the marriage certificate. 6. Learned Additional Chief Standing Counsel submits that during this period neither any FIR has been lodged or there is hardly any report with regard to any harassment or hindrance created by family members of either of the petitioners and as such no cause of action survives before petitioner nos. 1 and 2 for pursuing the instant petition and hence the prayer cannot be exceeded as mentioned in the instant petition. 7. In view thereof, present petition stands disposed of. 8. However, it is made clear that the protection granted earlier to the petitioners is hereby discontinued and extension shall be subject to fresh assessment made by concerned police authority. It is also made clear that concerned police authorities are directed not to interfere in peaceful living of petitioner nos. 1 and 2 in pursuance to marriage solemnized between them.
