By way of this petition, petitioner sought the following relief(s) : “(A) To call for the record for the perusal of this Hon’ble Court. (B) That, this Hon'ble Court may kindly issue a writ of Mandamus and issue diretions to the respondent authorities for conducting proper medical examination of Respondent No.6 as per the orders passed by department. (C) That any other relief which this Court thinks fit in the interest of justice and equity.” 2. Learned counsel appearing for the petitioner contended that the respondent no.6 was appointed on 21.01.2022 to the post of Sub- Engineer under the Special Recruitment Drive for physically disabled persons at Public Works Department, and secured his appointment based on his physical disability (deafness). The instant petition is being filed against the inaction on the part of respondents Authorities in not complying the order passed by Hon'ble High Court and orders of General Administration Department (GAD) for verification and fresh medical examination of employees/officers who have obtained job on the basis of medical certificate after 01-01-2019. Hence, this petition. 3. Learned counsel for the State opposes the submission made by counsel for the petitioner and contended that petitioners have no locus to challenge the appointment of respondent No.6. He further contended that in terms of direction issued by the GAD, respondent No.6 again 3 examined by the Medical Board and respondent No.6 submitted his medical disability certificate before the competent authority and competent authority, i.e., Chief Engineer- PWD, Nawa Raipur Atal Nagar, wrote a memo No.39082071 dated 29.02.2024 that the petitioner has been directed to appear before the Medical Board by way of letter dated 21.07.2023 and thereafter the petitioner appeared before the Medical Board and again he has filed new disability certificate on 01.12.2023. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties. In view of the above, it is crystal clear that as per the report of the Chief Engineer, the petitioner has physically examined by the Medical Board and the Board issued a fresh disability certificate. It is pertinent 5 to mention that the petitioners have no locus standi to challenge the appointment of respondent No.6. However, the petitioners have filed the petition for the reasons based known to them. 7. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed.
