This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 08/2025 registered at Police Station – Cyber Range Bilaspur, District – Bilaspur (C.G.) for the offence punishable under Sections 61, 317(5), 318(4), 111(3)(4) and 323 of the Bharatiya Nyaya Sanhita, 2023 (BNS).
2. Case of the prosecution, in brief, is that on the basis of the information received from the Samanvya Portal operated by Government of India, and the Police headquarters, and after due investigation, it was found RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 that the users and account holders of several banks namely UCO Bank, ICICI Bank, Kotak Mahindra Bank, SBI, Bandhan Bank, Bank of Baroda, Indian Bank and various other banks thorugh conspiracy, money has been stolen from the account holders, without their consent and by luring them. It is further alleged that such mule accounts were used to harm the victims and take undue advantage of the defrauded money. Total 82 mule accounts have been duped and a total sum of Rs. 97,83,492/- was deposited fraudulently. On the basis of this information, the Police registered the FRI, and pursuant to a memorandum statement of the co-accused, arrested the applicant and subsequently filed a charge-sheet. Hence, this application.

Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the charge-sheet has been submitted in this case and the co-accused has been granted by this Court vide
order dated 27.05.2025 passed in MCRC No.4071/2025, order dated 20.05.2025 passed in MCRC No.3966/2025, order dated 27.05.2025 passed in MCRC No.4103/2025, and order dated 29.05.2025 passed in MCRC No. 4137/2025, 4148/2025 and 4182/2025. The applicant is in jail since 25.02.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel opposes the bail application and submits that from the perusal of the case-diary it transpires that the case is related to online cyber fraud and the accused person are said to open bank accounts of people involved in online gaming and online fraud and received commission from opening the said accounts and also did online verification of those opened accounts and also did
3 the work of frozen accounts, further during the course of investigation the fraud amount of Rs. 97,83,492/- has been found deposited in total 82 bank accounts, and the role of the applicant in the present case is that he has opened the bank account registering the number of co- accused and the said account used for transaction of suspicious money, and the bail applications of the co-accused persons have been rejected by this Court vide order dated 12.06.2025 passed in MCRC Nos. 4141/2025, 4200/2025, 4206/2025, 4332/2025, 4334/2025 and 4336/2025, and orders dated 10.07.2025, 18.06.2025 and 08.08.2025 passed in MCRC Nos. 5383/2025, 4621/2025 and 6312/2025. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the charge-sheet has been filed in the present case, and from the perusal of the case-diary it transpires that the case is related to online cyber fraud and the accused person are said to open bank accounts of people involved in online gaming and online fraud and received commission from opening the said accounts and also did online verification of those opened accounts and also did the work of frozen accounts, further during the course of investigation the fraud amount of Rs.
97,83,492/- has been found deposited in total 82 bank accounts, and the role of the applicant in the present case is that he has opened the bank account registering the number of co- accused and the said account used for transaction of suspicious money, though some of the co-accused persons are said to be released on bail by this Court vide order dated 27.05.2025 passed in
4 MCRC No.4071/2025, order dated 20.05.2025 passed in MCRC No.3966/2025, order dated 27.05.2025 passed in MCRC No.4103/2025, and order dated 29.05.2025 passed in MCRC No. 4137/2025, 4148/2025 and 4182/2025, but also considering the fact that the bail applications of the co-accused persons have been rejected by this Court vide order dated 12.06.2025 passed in MCRC Nos. 4141/2025, 4200/2025, 4206/2025, 4332/2025, 4334/2025 and 4336/2025, and orders dated 10.07.2025, 18.06.2025 and 08.08.2025 passed in MCRC Nos. 5383/2025, 4621/2025 and 6312/2025, looking to the gravity and seriousness of the matter as it appears to be an organized cyber crime, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, this first bail application of applicant – Suresh Singh Thakur involved in Crime No. 08/2025 registered at Police Station – Cyber Range Bilaspur, District – Bilaspur (C.G.) for the offence punishable under Sections 61, 317(5), 318(4), 111(3)(4) and 323 of the BNS, is rejected at this stage. 8. Needless to say that the concerned trial Court is at liberty to proceed with the trial and conclude the same, expeditiously. 9.
