1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 302/2025, registered at Police Station – Telibandha, District – Raipur (C.G.) for the offence punishable under Section 22(b) of the NDPS Act.

It transpires from the record that the FIR which was registered against the applicant and the co-accused namely Praveen Kesharwani was for the offence under Section 20(B) of the NDPS Act, whereas in the bail rejection order of the trial Court, the same is mentioned as 22(B) of the NDPS Act. 3. The applicant is directed to move an appropriate application before the trial Court for correcting the aforesaid error and the offence in which the applicant is detained, and thereafter, file an appropriate application for grant of bail.

Learned counsel for the applicant prays that the present bail application be dismissed as withdrawn with liberty to file a proper bail application, after getting the necessary corrections done.
5. Permission is granted.
