DEPUTY SOLICITOR GENERAL OF INDIA The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.6058 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue an appropriate writ, order or direction more particularly, one in the nature of one in the nature of Writ of Mandamus, declaring the action of the respondents police i.e.. respondents 2 to 6 in not arresting unofficial respondent and not issuing Red Corner Notice against them who are residing at Abroad i.e., Muscutt and Jeddha who is illegally harassed the petitioner mentally and physically and accused in 498-A case and 3 and 4 of DP Act and the police did not taken any action against the 7th a ld 8th respondents in pursuant to NBW's in the C.C. No.1140 of 2018 pending before the Additional Judicial First Class Magistrate, Tiruvuru, Krishna District is highly illegal, arbitrary and against the principles of natural justice and also violative of Articles 14,19 and 21 of the Constitution of India and consequently direct the respondents 2 to 6 to arrest the 7th and 8th respondent by issuing Red Corner Notice and cancel the passport of the 7th respondent, in the interest of justice.” 2. None appeared for the writ petitioner. Earlier also there was no representation for the writ petitioner. 4 3. Learned Additional Government Pleader for Home on written instructions would submit that police registered a case in Crime No.215 of 2017 of Tiruvuru Police Station for the offence under sections 498-A of IPC and under sections 3 and 4 of the Dowry Prohibition Act, 1961, on 08.09.2017, and investigated into the case and filed charge sheet on 20.12.2017 vide C.C.No.140 of 2018 on 18.05.2018, and later case was compromised on 12.03.2022 under section 320(8) of Cr.P.C before the Additional Judicial Magistrate of First Class, Tiruvuru. 4. The writ petition was filed alleging that the respondent/police not arresting the unofficial respondent and not taking steps to procure his presence in C.C.No.1140 of 2018 on the file of Additional Judicial Magistrate of I Class, Krishna District. 5. Now the report of the learned Additional Government Pleader for Home would disclose that the Calendar Case was compromised on 12.03.2022. 6. In that view of the matter, the Writ Petition has become infructuous and liable to be dismissed. 7. Accordingly, the Writ Petition is dismissed as infructuous.
