1. This petition being Union of India & Ors. v. Col. Balbir Singh (Retd.), W.P.(C) No. 140/2024 is listed on the basis of a communication received from the Joint Registrar of the Armed Forces Tribunal, Principal Bench, West Block-VIII, R. K. Puram, Sector-1, New Delhi (“Tribunal”) dated 10.03.2026 wherein the following has been stated:-
“I am directed to forward herewith a true copy of the order dated 27.02.2026, passed by the Hon'ble Armed Forces Tribunal, Principal Bench, New Delhi in the above-mentioned matter and request you to bring to the notice of the Hon'ble Delhi High Court the fact with regard to non- implementation of the

Tribunal in OA 1021/2022 dated 19.05.2023 and the order passed by the Hon'ble Delhi High Court at the time of dismissal of the Writ Petition bearing W.P.{C) No.140/2024 titled Union of India & Ors. vs. Col Baibir Singh (Retd). A request be placed before the Hon'ble Chief Justice of the Hon'ble Delhi High Court for taking contempt action against the respondents for disobedience not only of this Tribunal's order but also of the order of the Hon'ble Delhi High Court and the Hon'ble Supreme Court's order passed in the SLP.”
2. The said letter encloses the order passed by the Tribunal on 27.02.2026 in MA No. 4800/2023. Paragraph 7 of the order of the Tribunal reads as under:-
“7. Accordingly, in the light of the aforesaid, we direct the Joint Registrar (Judicial) to refer to the matter to the Registrar General of the Hon'ble Delhi High Court and bring to the notice of the Hon'ble Delhi High Court the fact with regard to not only non-implementation of the order passed by this Tribunal in OA 1021/2022 dated 19.05.2023 but also the order passed by the Hon'ble Delhi High Court at the time of dismissal of the Writ Petition bearing W.P.(C) No. 140/2025. A request be placed before the Hon'ble Chief Justice of the Hon'ble Delhi High Court for talcing contempt action against the respondents for disobedience not only of this Tribunal's order but also of the order of the Hon'ble Delhi High Court and the Hon'ble Supreme Court's order passed in the SLP.”

The petitioners shall file an affidavit within two weeks as to what action has been taken pursuant to the decision of the Tribunal dated 19.05.2023 as we note that the aforesaid writ petition has been dismissed by this Court and the SLP filed by the Union of India before the Supreme Court was also dismissed vide order dated 14.11.2025. The affidavit must also state reasons as to why the order of the Tribunal after the dismissal of the SLP has not been implemented. The affidavit be filed within two weeks. 6. Re-notify on 09.04.2026.
