The Court made the following: ORDER: (Per Hon’ble Sri Justice B. Krishna Mohan)
Heard the learned counsel for the petitioner. 2. This contempt case is filed against the order passed in W.P.No.1658 of 2024 dated 24.01.2024, wherein, the petitioner withdrawn the writ petition with a liberty to approach the competent authority i.e., the Controlling Authority under the provisions of the Section 7 of the Payment of Gratuity Act, 1972. 3. Accordingly, the said writ petition was disposed of, giving such liberty to the petitioner to approach the Competent Authority by way of an application under the said Act and in the event an application is being made within two (02) weeks from the date of receipt of the said order, the application shall be entertained by the Controlling Authority without referring to the aspect of limitation. That was the observation made in the order of the Division Bench of this Court dated 24.01.2024. 4. The learned counsel for the petitioner submits that accordingly the petitioner made application under Section 7 of the said Act before the competent authority and the same is pending. 5.
At best it may create another cause of action to assail the inaction of the said respondent authority/the competent authority for non-disposal of the application, if any, pending before the said authority, which was made by the petitioner in pursuance of the orders of this Court in the above said writ petition. But surely, no cause of action arises in filing this contempt case. 4 HBKM,J & HVN,J C.C.No.1265 of 2025
