HON'BLE MR. JUSTICE RAVI CHIRANIA Order 18/12/2025 1. The present applicant Shailendra Kumar S/o Satyanarayan, aged about 32 Years has preferred this bail application under Section 483 of B.N.S.S. challenging the order dated 13.10.2025 passed by the Additional District and Session Judge No.1, Alwar (Raj.), in connection with the FIR bearing No.52/2024 dated 23.01.2024 registered at Police Station Aravali Vihar District Alwar in respect of an incident dated 25.04.2024. 2. Learned counsel for the applicant submits that in respect of the similar allegations, the co-ordinate Bench of this Court has enlarged the other co-accused persons namely Hitesh Kumar S/o Shri Harnarayan on bail vide order dated 14.11.2025. Learned counsel further submits that the other co-accused persons Sandeep and Sahil have also been enlarged on bail vide orders [2025:RJ-JP:51305] (2 of 2) [CRLMB-13982/2025] dated 17.11.2025 and 02.12.2025. In view of this fact, learned counsel for the applicant seeks parity and submits that the present applicant may be enlarged on bail. 3. Learned Public Prosecutor has strongly opposed the bail application and submits that the accused-applicant may not be enlarged on bail. 4. This Court considered the fact that the offences for which allegations leveled against the accused-applicant are triable by the Magistrate and the other co-accused have already been enlarged on bail by the co-ordinate Bench of this Court including the Trial Court. 5. Considering the overall facts, circumstances of the case and to maintain parity, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-applicant on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-applicant - Shailendra Kumar S/o Satyanarayan shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
