LAKSHMANA RAO CRIMINAL PETITION NO: 10860/2025 Between: A Munawar Alias S Munawar Khan and Others ...PETITIONER/ACCUSED( S) AND The State Of Andhra Pradesh ...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused(S): N Chandra Sekhar Reddy Counsel for the Respondent/complainant: Public Prosecutor The Court made the following: ORDER: Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023^ by the Petitioner Nos.1 to 3/Accused Nos.2 to 4 for granting of pre-arrest bail in connection with FIR No.121 of 2024 of Hindupur II Town Police Station, Satya Sai District, registered for the alleged ^the BNSS r 2 offences punishable under Sections 85 and 108 read, with 3(5) of the Bharatiya Nyay Sanhita, 2023^. 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. As seen from the record, Petitioner No. 1/Accused No.2 is the father-in- 3. law of the deceased, aged about 50 years, and is a lorry driver. Petitioner No.2/Accused No.3 is the brother-in-law of the deceased, aged about 25 years. Petitioner No.3/Accused No.4 is the wife of the brother-in-law of the deceased. The entire allegations leveled by the de facto complainant are against the son-in-law/husband of the deceased. The de facto complainant is the mother-in-law of Accused No.1. The deceased was not residing in the house of the petitioners; she was living separately in a rented house, where she committed suicide by hanging. Accused No.1 has already been arrested and is presently in judicial custody. Considering the facts and circumstances of the case, gravity and nature 4. of the allegations levelled against the Petitioner Nos.1 to 3/Accused Nos.2 to 4, this Court deems it fit to grant pre-arrest bail to the Petitioner Nos.1 to 3/Accused Nos.2 to 4. In the result, the Criminal Petition is allowed with the following 5. conditions: In the event of their arrest, the Petitioner Nos.1 to 3/Accused Nos.2 to 4 shall be enlarged on bail subject to I. ^the BNS "N „ 3 them executing a bond for a sum of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; The Petitioner Nos. 1 to 3/Accused Nos.2 to 4 shall make themselves available for investigation as and when required: < The Petitioner Nos.1 to 3/Accused Nos.2 to 4 shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner Nos.1 to 3/Accused Nos.2 to 4 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. The Petitioner Nos.1 to 3/Accused Nos.2 to 4 shall not leave the district limits without the express permission from the Station House Officer concerned. The Petitioner Nos.1 to 3/Accused Nos.2 to 4 shall surrender their passport, if any, to the investigating officer.
