1. With the consent of the parties the matter is heard finally.
2. The present writ petition has been filed by the petitioner seeking following relief:- 10.1 That this Hon’ble Court may kindly be to issue a writ of mandamus or any other appropriate writ,
order, or direction, directing the respondent authorities to grant 2 acres of government land (out of Khasra No. 725, area 3.31 hectares) to the Digitally signed by JYOTI JHA Date: 2025.09.11 11:16:39 +0530
2 petitioner for agricultural purposes, subject to compliance with applicable rules and conditions. 10.2 That this Hon’ble Court may kindly be pleased to direct the respondents to consider and decide the petitioner’s application dated 10.01.2025 within a time-bound manner, preferably within a period of three months. 10.3That this Hon’ble Court may kindly be pleased to pass any other order(s) or direction (s) as this Hon’ble Court may deem fit and proper in the interest of justice, equity and good conscience;

Learned counsel for the petitioner submits that the petitioner is not challenging any particular order but this petition is filed seeking direction to the respondent authority to grant 2 acres of vacant government land out of Khasra No. 725, area 3.31 hectares, under continuous and undisputed possession for the past 20 years, for agricultural purposes to petitioner. Learned counsel for the petitioner submits that the Gram Panchayat, Debalbhatha, conducted a spot inspection, prepared a panchnama, and passed a resolution on 26.11.2024 in favour of granting the petitioner rights over the land, with no objections from villagers. Despite the petitioner’s application to the Collector, Mahasamund, on 10.01.2025 which is still pending.

Learned counsel for respondents submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent-authorities to consider the pending application, he is having no objection to the limited prayer and pending application dated 10.01.2025 will be considered in accordance with law.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Considering the facts and circumstances of the case instead of keeping
3 this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent No. 2 to consider/decide the application of the petitioner (Annexure P-4) dated 10.01.2025 in accordance with law/rules/regulations as expeditiously as possible.
7. It is made clear that this Court has not expressed anything on the merits of the case.
8. With the aforesaid direction, the writ petition is disposed of. Sd/-
