JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. The petitioner including the 1st petitioner- Organisation for Unaided Recognised Schools (R) is before this Court being aggrieved of the impugned communications at Annexures-B and C made by the 3rd respondent-Block Education Officer calling upon the petitioners to furnish certain information as noticed in the communication. Learned counsel for the petitioners - 5 - HC-KAR NC: 2025:KHC:38322 WP No. 28832 of 2025 submits that at Annexure-B is a proceedings of the Information Officer pursuant to an application made under the Right to Information Act at the hands of one Sri Pramod.N.R. Learned counsel submits that pursuant to the application filed by the said person communication has made by the Block Education Officer to furnish the information sought by the said person. Challenge is raised to the said communication at Annexure-C dated 14.08.2025. 3. Learned Additional Government Advocate raises a preliminary objection that the writ petition is pre-mature. Learned Additional Government Advocate submits that if the petitioners want to give the information they may give or the Information Officer will pass necessary orders pursuant to the application made by the said person namely Sri Pramod.N.R, learned Additional Government Advocate submits that unless any order is passed by the competent authority or action is taken by the competent authority, no cause of action will arise for the petitioner to - 6 - HC-KAR NC: 2025:KHC:38322 WP No. 28832 of 2025 approach this Court seeking to quash the communication at Annexure-C. 4. Learned counsel for the petitioners submits that the petitioners have already given their reply to the communication at Annexure-C, as per Annexure-D series. 5. In the considered opinion of this Court, there is substance in the submission made by the learned Additional Government Advocate. 6. The statute in the Right to Information Act prescribes a procedure for consideration of an application and the consequences that flow if any authority fails to give the information. If such persons/authority are aggrieved of any action taken under the provisions of the Right to Information Act, elaborate proceedings are prescribed under the statute itself for remedy. Therefore, even if the petitioners have given the reply to the communication at Annexure-C, unless any orders are passed or action is taken, the petitioners will not get any - 7 - HC-KAR NC: 2025:KHC:38322 WP No. 28832 of 2025 cause of action to question the communication at Annexure-C. 7.
