The applicant who is in custody since 25.09.2023 has renewed the prayer for grant of regular bail in connection with Gumla P.S. Case No.61/2023, corresponding to Special POCSO Case No.08/2023, registered for the offence under Sections 366-A/ 376-DA of IPC and Section 6 of the POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO-cum-Additional Sessions Judge-IV, Gumla. 2. It appears that the applicant is an accused of committing rape upon the victim girl. 3. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 4. Earlier the bail application of this applicant was rejected on 21.06.2024 passed in B.A. No.3568 of 2024. Prayer for bail of the applicant has been renewed stating that the charge has been framed on 19.01.2024 and some of the charge sheeted witnesses have already been examined. On the above basis, prayer for bail has been renewed. 5. Learned A.P.P. has opposed the prayer for bail of the applicant and submitted that the victim girl has made direct allegation of rape against this applicant. 6. Considering the nature of allegation and the age of the victim girl, I am not inclined to enlarge the applicant on bail, at this stage.
