THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. The grievance of the petitioners is that although the Committee for regularization of unauthorised occupation was informed that Sri.Venkataramanappa, the husband of first petitioner and father of the other petitioners was in unauthorised occupation of 1 acre 5 guntas, as can be seen at Annexure-B, nevertheless, the Committee granted only 25 guntas of land and saguvali chit was also issued to Sri Venkataramanappa at Annexure-D, on 22.06.1999 and revenue entries are also made in the name of Sri.Venkataramanappa to an extent of 25 guntas that were granted.
After the demise of Sri.Venkataramanappa, the name of the first respondent, has been entered in the revenue records. The prayer in

HC-KAR NC: 2025:KHC:34420 WP No. 7104 of 2024 the writ petition is to issue necessary directions to the respondents to grant the remaining extent of land, namely 20 guntas of land, which was not granted by the Committee. 3. In the considered opinion of this Court, such a direction cannot be given, since admittedly the application filed by Sri.Venkataramanappa was considered and the Committee took a decision to grant only 25 guntas of land to Sri.Venkataramanappa. It was for Sri.Venkataramanappa, to have raised a challenge to the orders passed by the committee and the Tahsildar restricting the grant only to 25 guntas although Sri.Venkataramanappa was in possession of 1 acre 5 guntas. 4. Nevertheless, if the petitioners seek to raise a challenge to such an order passed by the committee, they may do so in accordance with law. - 5 -
