This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.73/2025 registered at Police Station – Geedam, District-Dantewada (C.G.) for the offences punishable under Sections 303(2), 317(2), 336(2), 340(2), 345(2), 345(3), 3(5) of BNS, 2023. As per the prosecution story, on 24.07.2025 under the leadership of Police Incharge Inspector Vijay Patel, along with his staff, they went for MCP proceedings near Geedam Pandey Dhaba, where during checking of vehicles, notice was given to the driver of red colour Splendor vehicle number CG-17 C 1880, Gulshan Nahata, to produce documents related to the vehicle and he said that he did not have any documents. On suspecting that the motorcycle may be stolen, information was obtained from online RTO, and the vehicle registration number CG 17 C1880 was not of Splendor motor cycle, but of the said vehicle number Alto Car, owned by Mahesh Ram Baghel. On questioning the accused Gulshan Nahwa, he told that the motor cycle was stolen, and also disclosed that the applicant/ accused Praveen Golcha, in connivance with other accused, had made fake RC of stolen motorcycle. Cards and number plates are made and, available for sale, so that stolen vehicles can be sold to other persons. After the above facts came to light, police station Geedam registered crime No.73 of 2025 against the accused. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. She would submit that only on the basis of memorandum statement of the co-accused, present applicant has been implicated in crime in question and co-accused persons granted bail by the concerned trial Court. She also submits that investigation and trial are likely to take time, therefore, he 3 submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that applicant is involved in theft case of the motorcycles, which were recovered from Hyderabad. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, gravity of offence, submission made by learned counsel for the applicant and also looking to the face that applicant is involved in theft case of motorcycles, which were recovered from Hyderabad, as such, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the anticipatory bail application of the applicant– Praveen Kumar Jain filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.73/2025, registered at Police Station–Geedam District – Dantewada (C.G.) for the alleged commission of offence punishable under Sections 303(2), 317(2), 336(2), 340(2), 345(2), 345(3), 3(5) of BNS, 2023, is rejected.
