THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: Digitally signed by GEETHA P G Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2025:KHC:38685 WP No. 29444 of 2025 CORAM: HON'BLE MR. JUSTICE M.I.ARUN ORAL ORDER 1. The petitioner in the instant writ petition has challenged the show cause notice dated 02.09.2025 (vide Annexure-A to the writ petition) issued by the respondent alleging that the petitioner has put up illegal construction on the property belonging to the Government. 2. The case of the petitioner is that the construction is put up on his property and not on the Government land. 3. It is noticed that in the show cause notice, seven days' time is granted to the petitioner to show cause as to why action should not be initiated against him. I do not see any error in the same. It is always open for the petitioner to submit to the authorities that the land belongs to him and not the Government. 4. Hence, the following: ORDER The petitioner is given liberty to file a reply pursuant to the impugned show cause notice (vide Annexure-A to the writ - 3 - HC-KAR NC: 2025:KHC:38685 WP No. 29444 of 2025 petition) within the time stipulated therein, if the reply is not already given. The respondent shall act against the petitioner only after considering the reply in accordance with law and not otherwise. The writ petition stands disposed of accordingly. Sd/- (M.I.ARUN) JUDGE hkh.
