Sonali Mane 37-WP-10943-2024.docx P.C. : 1)
It appears that the Petition has been rendered infructuous on account of directives issued by the State Government on 1 January 2025, which inter alia contemplates preparation of fresh provisional voters list and for implementation of fresh election programme.
2)
Mr. Kulkarni, the learned counsel appearing for the Petitioner would express an apprehension that since the order dated 1 January 2025 is challenged in various Petitions before the Division Bench, in the event of the order dated 1 January 2025 being set aside, the Respondents are likely to proceed on the basis of the provisional voters list, which is subject matter of challenge in the present Petition. In my view, in case such eventuality arises, the Petitioner would be at liberty to file a fresh Petition challenging the very same provisional voters list, which is under challenge in the present Petition. This would sufficiently protect the interest of the Petitioner.
3)
Writ Petition is accordingly disposed of. In view of disposal of Writ Petition, Interim Application does not survive and the same stands disposed of.
4)
All contentions on merits are expressly kept open.
