Order 09/10/2025
1. The petitioners have filed this bail application under Section 483 of BNSS in FIR No.63/2025 registered at Police Station Kaithwara District Deeg for offence under Sections 303(2), 317(2), 319(2), 318(4), 338, 336(3), 340(2), 61(2) of BNS, 2023 and Section 66-D Information Technology (Amendment) Act, 2008.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. He further submits that allegation against the petitioners is of using fake Sims. He argued that co-accused Shaikul has been enlarged on bail by this Court on 01.07.2025 and other eight persons namely
[2025:RJ-JP:41172] (2 of 2) [CRLMB-12981/2025] Toufik, Ajruddin, Sarfaraj, Hasid Khan, Abid, Qayyum, Satish Kumar and Asif have already been enlarged on bail by the co- ordinate Bench of this Court. The case of the present petitioners is akin to that of other co-accused, therefore, on the ground of parity, petitioners are also entitled to be granted benefit of bail. His other contention that that petitioners are behind the bars since 15.09.2025 and trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Shakeel Khan S/o Chawla and Amir Alias Amir Khan S/o Shahjaha @ Shahjan Khan be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
