1. State of Rajasthan, Through P.P.
2. Amit Tiwari S/o Vinod Tiwari, R/o Chuna Chok Fatehpur ,fatehpur Kotwali ,district Sikar. ----Respondents For Petitioner(s) : Mr. Sumer Singh Ola For Respondent(s) : Mr. Rishi Raj Singh Rathore, PP Mr. Aman Agarwal, AAAG Mr. Ravinder Singh Shekhawat Mr. Mahendra Shandilya Mr. Sunil Vashishtha HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 06/05/2025
1. The petitioner has preferred this petition under Section 528 of B.N.S.S. 2023 for quashing the First Information Report No.82/2025 registered at Police Station Fatehpur Kotwali, Distrcit Sikar for the offence under Section 196(1)(a), 299 & 302 of B.N.S. and Section 66(F)of I.T. Act, 2000. 2. It is contended by counsel for the petitioner that the FIR against the petitioner is false and fabricated and no case is made out against the petitioner. The petitioner posted a song "Mujre Wali Hoon" of Movie Awaargi in his facebook ID and in the post, the petitioner has neither hurt the communal sentiments of other community nor use any abusive language. It is contended that the
[2025:RJ-JP:19036] (2 of 4) [CRLMP-2353/2025] said song "Mujre Wali Hoon" pertains to a Movie Awaargi which was released in the year 1987. Therefore, mere posting a song
"Mujre Wali Hoon" does not constitute any offence as alleged in the FIR. It is also contended that petitioner after posting the said song deleted it immediately and also published his clarification on his facebook post. The FIR against the petitioner is based upon surmises and conjectures. Therefore, FIR No.82/2025 registered at Police Station Fatehpur Kotwali may be quashed. It is also contended that Hon'ble Apex Court recently in the matter of Imran Pratapgadhi Vs. State of Gujarat & Anr., Criminal Appeal No.1545/2025 dated 28.03.2025, while quashing the criminal proceedings initiated against Imran Pratapgadhi observed that free expression of thoughts by an individual or group of individuals is an integral part of highly civilized society and in the given case no offence prima facie made out against the petitioner under Section 196, 197, 299 & 302 of B.N.S. It is further contended that Allahabad High Court in the case of Imran Khan Vs.
State of U.P. & Anr., dated 17.04.2025 at Para No.16 observed as under:-
"16. A person, who forwards the message, must be construed to acknowledge the contents of the message and that is the main reason as to why he forwards that message to others. In other words, the recipient of a message, who wants others also to know about that message, forwards that message to others. Once that is done, he has to take the responsibility for having forwarded the message to others. A person, who gets a dopamine high by looking at the likes for the message forwarded by him, must also be equally prepared to face the consequence, if that message has a derogatory content." Considering the above aspects, the FIR lodged against the petitioner may be quashed and set aside. [2025:RJ-JP:19036] (3 of 4) [CRLMP-2353/2025]
3. Learned Public Prosecutor has vehemently opposed the petition and submitted the factual report. 4. It is contended by learned counsel for the respondent that the petitioner posted outrageous message on his Facebook account which was deliberate and with malicious intention to outrage the religious feeling of a particular class.
The post which appeared on petitioner facebook ID was as under:-
"

At this juncture, it cannot be said that the aforesaid post was not with malicious intention. The Police after inquiry has reached to the conclusion that prima facie a case againt the petitioner for offence under Section 196(1) (a), 299 & 302 of B.N.S. and Section 66(F)of I.T. Act, 2000 is made out. Therefore, no relief may be granted to the petitioner. 5.
The Apex Court in the matter of Imran Pratapgadhi (Supra) quashed the proceedings against the petitioner Imran Pratapgadhi as the song was not meant to abuse or outrage the religious feeling of any particular religion. The High Court of
[2025:RJ-JP:19036] (4 of 4) [CRLMP-2353/2025] Gujarat also observed that no offence was made out on the face of it. The case of the petitioner differs from the case of Imran Pratapgadhi (Supra). Similarly, the observation made at Para 16 in the judgment of Imran Khan Vs. State of U.P. & Anr., (Supra) is of no relevance to the present controversy. The facts of Imran Khan case are different and it cannot be equated with the present case. Therefore, considering the above facts this Court is not inclined to quash the criminal proceedings against the petitioner. 6. Accordingly, this criminal miscellaneous petition is hereby dismissed.
