Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. The petitioner by means of the present petition, has prayed for the following reliefs:- "1) Issue a writ, order of direction in the nature of certiorari for quashing the impugned order dated 5.2.2024 passed by the respondent No.3,Sub Divisional Magistrate Mau District Mau (Vide Annexure No.11 to this writ petition) ii) Issue a writ, order of direction in the nature of mandamus commanding and directing the respondents to restore the possession of the petitioner over the land in question gata No. 148/2 measuring area 0.2020 hectare situated in village Sahadatpura Arban Pargana Mau Tehsil Maunath Bhanjan District Mau forthwith or within stipulated period fixed by this Hon'ble court." 3. The petitioner has earlier approached this Court by filing Writ-C No. 33342 of 2023 in which the grievance of the petitioner is that his pathway has been blocked by encroachers and in this regard he has moved a representation before the respondent no.2, which has not processed till now. 4. In the aforesaid backdrop, this Court permitted the petitioner to file a fresh representation ventilating his grievance before the concerned Sub-Divisional Magistrate and directed the said authority to decide the same. The Sub- Divisional Magistrate has decided the grievance of the petitioner by order dated 06.02.2024, wherein the following findings were recorded. The relevant extract of the order is reproduced below: Versus Counsel for Petitioner(s) : Shashi Kant Dwivedi Counsel for Respondent(s) : C.S.C. Devendra Prasad Mishra .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) "राजस्व टीम की आख्या व पत्रावली का अवलोकन िकया गया। पत्रावली तथा राजस्व टीम की आख्या से स्पष्ट है िक याची राजस्व ग्राम सहादपुरा (अबर्न) परगना मऊनाथ भंजन तहसील सदर, जनपद-मऊ के फसली खतौनी 1430-1435 के खाता सं0 281 पर दजर् गाटा सं० 148/2 क्षेत्रफल 0. 202हे0 पर राजकु मार, आलोक पुत्रगण गनेश व कृ ष्णा देवी पत्नी गनेश आिद के साथ बतौर बैनामेदार उक्त गाटा में 0.04981 हे0 देवेन्द्र प्रसाद िमश्र पुत्र महेन्द्र िमश्र सा० अतरौल पाण्डेय के नाम संक्रमणीय भूिमधर के खाते में नाम अंिकत है जबिक िवपक्षी िवजय बहादुर पाण्डेय द्वारा मौके पर बतौर मकान अहाता बनाकर कािबज है। प्रकरण में मौके पर पक्की मकान व बाउण्ड्रीवाल बना हुआ है। मौके पर प्रश्नगत आराजी के सीमांकन हेतु कोई स्थायी िबन्दु नहीं पाया गया, िजसके कारण सीमांकन नहीं िकया जा सका। इस सम्बन्ध में याची को मौके पर तथ्यों से अवगत करा िदया गया है। तद्नुसार याची श्री देवेन्द्र प्रसाद िमश्र पुत्र स्व० महेन्द्र िमश्र (स्वतंत्रता संग्राम सेनानी) ग्राम व पोस्ट अतरौल पाण्डेय, रतनपुरा तहसील सदर जनपद-मऊ द्वारा प्रस्तुत प्राथर्ना पत्र िदनांक 06.11.2023 िनस्तािरत िकया जाता है। " 5. A perusal of the aforesaid findings reveals that the dispute is essentially between two private parties. The petitioner has purchased a plot out of Gata No. 148/2 to the extent of the share belonging to one Usha Devi, who held a 1/4th share in the said Gata. 6. Since the controversy involves disputed questions of fact, such issues cannot be adjudicated by this Court in the exercise of its writ jurisdiction under Article 226 of the Constitution of India. 7.
