The petitioner is apprehending his arrest in connection with Dumka Town P.S. Case No.137 of 2025, for offence registered under section 74, 308(3), 352, 351(2), 351(3), 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Dumka.

Learned counsel for petitioner submits that friendship was established between the petitioner and the informant in the month of August, 2024 itself and thereafter they were in relationship. He submits that, however, the relationship has been broken and off and on the altercation was going on between the petitioner and the informant. He submits that apprehension is there that the petitioner will be made accused in false case and in view of that Annexure-2, informatory petition was filed before the learned Chief Judicial Magistrate, Deoghar. He also draws the attention of the Court to the Whatsapp chat between the petitioner and the informant and he submits that they were in relationship. However, the

marriage of the petitioner was solemnized with another girl and thereafter the present case has been lodged.
4. Learned State counsel opposes prayer and submits that the allegations are there of establishing the relationship on the pretext of marriage.
5. Looking to the contents of the FIR it transpires that they came into relationship in August 2024 and several times they have met at different places. The petitioner has filed the informatory petition as contained in Annexure-2 and thereafter the present case has been lodged. The Whatsapp chat annexed with the petition further strengthens the argument of the learned counsel appearing for the petitioner, and in the facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Dumka, in connection with Dumka Town P.S. Case No.137 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
