CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO DATE : 6th November, 2025 P C :
The only grievance expressed in the present writ appeal is that the appellant was being evicted from the plot in question which was gifted to the appellant by his wife, by force and not following due process.
2. The learned single Judge by virtue of the judgment and order impugned had dismissed the petition filed by the appellant herein on the ground that the petitioner had not been able to satisfy as to the genuineness of the claim of the source of acquisition of the plot in question by the wife who claimed that the property had devolved upon her through her ancestors.
2 HCJ & RRR, J WA_1133_2025
3. On a pointed question as to whether the appellant was in possession of the property in question, learned counsel for the respondents expressed that they have no instructions in that regard.
4. Be that as it may, in case the appellant is in possession of the plot in question then the appellant be evicted from the plot in question only in accordance with law by adopting due process. The Writ Appeal is disposed of accordingly. No order as to costs.
