Neutral Citation No. - 2025:AHC:87990-DB Court No. - 3 Case :- WRIT - C No. - 11024 of 2025 Petitioner :- M/S Tribhuwan Singh Gautam & Siddhant Gautam Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Gulrez Khan,Javed Husain Khan Counsel for Respondent :- C.S.C.,Sanjay Kumar Om Hon'ble Salil Kumar Rai,J. Hon'ble Arun Kumar Singh Deshwal,J. Despite two opportunities having been granted to the respondents, no counter affidavit has been filed. Today the counsel for the respondents prayed for further time to file a counter affidavit. It would serve no useful purpose to keep the writ petition pending and grant further time to the respondents to file a counter affidavit. The petitioner claims that Rs.16,16,552/- is due to him by the Uttar Pradesh Jal Nigam (Rural) Gwalior Road, Jhansi for the work done by him in pursuance of a contract executed between him and the Jal Nigam. The documents annexed with the writ petition show that Rs.14,41,190/- and not Rs. 16,16,552/- is due to the petitioner. The amount of Rs.14,41,190/- appears to have been admitted by the Executive Engineer and the Divisional Accountant of the Jal Nigam as evident from the payment order / token no. 95954. However, we are not recording any finding on the amount due to the petitioner. The petition is disposed of with the direction that in case, the petitioner submits a representation before the Chief Engineer, Uttar Pradesh Jal Nigam (Rural) District Jhansi for payment of his dues, the said representation shall be decided by the Chief Engineer within a period of one month from the date of filing the representation and in case any amount is found due to the petitioner, the same shall be released in favour of the petitioner and paid to him along with 6% simple interest per annum calculated from the date the amount became due to the petitioner within a period of two months from the date of the decision by the Chief Engineer, Uttar Pradesh Jal Nigam (Rural) District Jhansi. The order shall also apply on any other Officer, in case, the amount due to the petitioner is to be paid by any authority other than Chief Engineer, Uttar Pradesh Jal Nigam (Rural) District Jhansi. In any case, the whole exercise shall be completed by 15.09.2025. Order Date :- 23.5.2025 Vipasha Digitally signed by :- VIPASHA MUKHERJEE High Court of Judicature at Allahabad
