GUNDE SUNDARPAUL, S/O SUSESWARA RAO, AGED 52 YEARS, SOCIAL WORKER, D.NO. 20-7-28, GRACE E.M.P SCHOOL, SHANTHI NAGAR, VIJAYAWADA. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to pass a writ ,order or direction more particularly one in the nature of writ of mandamus under article 226 of Constitution of India declaring the action of the Respondent Police of Agiripalli, Krishna District in not acting on the complaint of the Petitioners dated 11.11.2018 against the unofficH Respondents despite of the fact that they have an injunctions order in IA No 894/ 2018 in OS No 135 of 2018 on the file of the Senior Civil Judge Court of Nuzvidu, Krishna District which is being extended till now in their favour against the Un Official Respondents, on the other hand the Respondent Police are in complete collusion with the unofficial Respondents attacked and damaged Trust Property and Petitioners personal belongings and forcibly evicted the Petitioners and Petitioner represented Bethlehem Charitable Trust Home in- mates totalling 20 persons who are orphan children, and destitute women and old aged persons is illegal and unlawful and against and in contravention of the TRUST ACT in general and in particular the very aims and objects of the Petitioner's BETHELEHEM CHARITABLE TRUST at Chopperametla of Agiripalli Mandal in Krishna District besides being violative of Article 14 and 21 of Constitution of India consequently direct the Respondent Police to register a case as per law on the complaint of the Petitioner under proper sections of SC and STs 3 Prevention of Atrocity Act against the unofficial Respondents by handing over the investigation to the DSP Nuzvidu and also direct both the official and unofficial Respondents to restore the Petitioner represented all the 20 in-mates of the BETHELEHEM CHARITABLE TRUST at Chopperametla of Agiripalli Mandal in Krishna District and hand over all their belongings back to them in view of the injunction orders in favour of Petitioners already there in force against the unofficial Respondents thereby set aside the injunction on the very same sub ect between very same parties in IA No 1454/ 2018 in OS No 224 of 2018 on the file of the very same Senior Civil Judge Court of Nuzvidu, Krishna District and also award costs and to pass IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents To arrest the unofficial Respondents who are named in the FIR No 237 / 2018 of Agiripalli Police Station forthwith pending disposal of the above writ petition and to pass Counsel for the Petitioner(S): 1. Sri R.Mallikarjuna Rao, learned Assistant Government Pleader for Home would submit that police registered a case in Cr.No.237/2018 of Agiripalli Police Station for the offence U/secs.448, 427, 506, 509, 354-A r/w.34 IPC. Hence, the writ petition has become infructuous. 3. The writ petition was filed to direct the police to register a case as per law on the complaint of the petitioner. 4. In that view of the matter, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
