When the present matter was taken up by learned predecessor Bench on 15.12.2025, while issuing notice, and while granting interim relief to the applicant, the following facts were noted:- “3. The present petition has been filed on behalf of the petitioner under Section 482 BNSS seeking anticipatory bail in connection with FIR No. 0446/2025 under Sections 420/468/471/34 IPC registered at PS-I.P. Estate. 4. As per the prosecution version, the FIR has been registered on the complaint of Mr. Sumit Khatana, who alleged that the applicant and one Manoj Chaudhary induced the complainant to pay a sum of Rs. 10 Lakhs on the pretext of securing a railway job. 5. Mr. Pushpender Shukla, learned counsel appearing on behalf of the petitioner submits that no amount has been received into the account of the present petitioner. He submits that the allegations in the FIR are against Manoj Chaudhary and not against the present petitioner. He contends that the petitioner is a government employee. 6. He further contends that when interim protection was granted by the learned Additional Sessions Judge, the petitioner had joined investigation. 7. As per the status report, petitioner herein has already joined the investigation and the charge-sheet has been filed before the learned Trial Court and cognizance has also been taken. 3. The next date before the learned Trial Court is stated to be 30.04.2026 and both the accused have been directed to appear on said date. 4. According to prosecution, the meeting between the complainant and co-accused Manoj Chaudhary was through the applicant herein. 5. Learned counsel for the applicant submits that the specific allegations are against the co-accused Manoj Chaudhary, to whom such sum of Rs.10 lacs was, allegedly, paid by the complainant on the pretext of securing a job in railways. He submits that, even as per the bare allegations, the applicant - Subhash Chand was merely accompanying him and his mere accompanying his co-accused would not, ipso facto, mean that he is also directly involved in any act of cheating, particularly, when there is nothing else to indicate his complicity. 6. Be that as it may, since the applicant has already joined the investigation to the satisfaction of the prosecution and charge-sheet has already been filed, the interim order dated 15.12.2025 is, hereby, made absolute with direction that on the abovesaid date i.e. 30.04.2026, the applicant would appear before the learned Trial Court and would also submit personal bond in a sum of Rs.25,000/- with one ‘local’ surety of the like amount. 7.
