THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.32059 of 2025 ORDER: The present writ petition is filed questioning the action of the respondents in not considering the petitioner’s claim for promotion to the post of District Registrar on account of the Radio Message dated 07.11.2025 pertaining to Surprise Check No.1/SC-ACB/VSP/2025, thereby denying him promotion though he is not under the currency of any disciplinary or criminal proceedings. The petitioner contends that such inaction is illegal and arbitrary. 2. Learned Assistant Government Pleader for Services-I, on instructions from the Deputy Inspector General of Registration and Stamps, Visakhapatnam, submitted that no panel for promotion to the post of District Registrar for the panel year 2025-2026 has been drawn so far.
It is further stated that the petitioner’s apprehension that his case is being overlooked on the ground of pendency of the Radio Message is only a presumption. The relevant portion of the instructions reads as follows:
“It is further submitted that it is not true that he was informed orally by the concerned authorities that his case is being overlooked on the ground of pendency of radio message. It is only a presumption of the Petitioner. It is submitted that no panel for promotion to the post of District Registrar for the panel year 2025-2026 was drawn so far as on date. It is submitted that nay grievance, if arising on account of non-consideration of his case by the Committee at the time of drawing the panel, may be

addressed by the Petitioner in accordance with the remedies available to him under law. Hence, the petitioner’s contention that his name is not being considered for promotion at this juncture is premature and liable to be dismissed, since no panel was drawn so far. It is submitted that the request of the applicant for promotion to the cadre of District Registrar will be considered only as per his eligibility and Rules in force as and when the case of the Petitioner candidature comes up for promotion.”
3. In view of the above instructions, and as no panel for the relevant year has yet been prepared, the writ petition is found to be premature. Accordingly, the writ petition is disposed of, leaving it open to the petitioner to re-agitate the matter as and when a proper cause of action arises. There shall be no order as to costs.
