[2025:RJ-JP:41347] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No. 3595/2012 Bashiruddin son of Haji Hasan, aged about 45 years, resident of Ward No.2, Laxmangarh Tehsil Laxmangarh District Sikar. ----Petitioner Versus 1. State of Rajasthan through the PP. 2. Abdul Sattar Chohan (Kaji) son of Shri Abdul Chohan, Parshad Ward No.2, Laxmangarh Tehsil Laxmangarh District Sikar. ----Non-petitioners For Petitioner(s) : Mr. Harendra Singh Sinsinwar For Respondent(s) : Mr. Vivek Sharma, PP Ms. Akriti Mathur for Mr. Amit Singh Shekhawat for complainant HON'BLE MR. JUSTICE ANAND SHARMA Order 10/10/2025 1. This criminal misc. petition has been filed by the petitioner feeling aggrieved by order dated 09.08.2012 passed by the learned Sessions Judge, Sikar (hereinafter to be referred as 'revisional Court') whereby, the revision petition filed by the petitioner under Section 397 Cr.P.C. against order dated 12.01.2012 passed by the Judicial Magistrate, Laxmangarh, District Sikar (hereinafter to be referred as 'trial Court') rejecting the protest petition filed by one Shri Hari Prakash Gupta, Enforcement Inspector, Civil Supplies, Laxmangarh and accepting negative final report proposed by the investigating agency, was dismissed. [2025:RJ-JP:41347] (2 of 2) [CRLMP-3595/2012] 2. Bare perusal of order dated 09.08.2012 would reveal that the revision petition was dismissed by the learned revisional Court only on the ground that the petitioner was stranger to the proceedings. He was neither complainant, nor investigator and was also not related to the proceedings. He failed to disclose his locus to file revision petition before the revisional Court. 3. At the outset, this Court also asked learned counsel for the petitioner to show his locus to file the instant criminal misc. petition, however, learned counsel has utterly failed to point out even a single fact, which may lead to any inference that the petitioner has got any locus whatsoever to file the instant criminal misc. petition. 4. In view of above, the instant criminal misc. petition is frivolous as also meritless and the same is, hereby dismissed. (ANAND SHARMA),J DIVYA /18
