---- 04/10.12.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Jorapokhar P.S. Case No.32 of 2025, for the alleged offences registered under Sections 87, 305 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M., 1st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that the petitioner No.1 and informant’s girl namely Rani Kumari both are living in Bangalore since last five years and in the meantime, they have developed relationship and affection has grown up and on 26.02.2024 they have solemnized marriage and affidavit to that effect has been executed before the Executing Magistrate, Dhanbad. He further submits that both are major. He then submits that the case diary was called for by the last

order and the victim has stated that she has gone along with the petitioner on her own volition and the family members are not ready for marriage along with the petitioner No.1 and that is why the FIR has been lodged. He next submits that on pressure of family members the statement under Section 164 of Cr.P.C. have been made by the victim.

Learned counsel appearing for the State submits that in 164 Cr.P.C. the allegations are made against the petitioner that on threat the petitioner has took away the victim girl.

In paragraph No.19 of the case diary it has come that girl has gone on her own volition along with the petitioner and both have sworn the affidavit before the Executing Magistrate wherein the photos are also attested and stated that they have solemnized the marriage and the said affidavit is taken on record. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M., 1st Class, Dhanbad in connection with Jorapokhar P.S. Case No.32 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
