Memo reads as under: “The above mentioned Petitioner submits as under; That in the top noted criminal petition, filed under section 438 of BNSS, 2023, the petitioner sought to enlarge him on bail in Crime No. 11/2025 registered by Respondent No. 1 registered for the offences punishable under section 85, 108, 115(2), 118(1), 352, 351(2) r/w 3(5) of B.N.S. 2023, in the interest of justice and equity. Subsequent to filing of the above noted criminal petition the Respondent Police have filed the Chargesheet in Crime No. 11/2025. Therefore, the Petitioner intends to withdraw the petition with liberty to file the petition before the Trial Court.
