Chatterjee, Advocate ---- 4/26.11.2025 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Complaint Case No.487 of 2025, for offence registered under section 33, 41, 42 of Indian Forest Act and section 27, 29, 51 of Conservation of Forest and Wildlife Act, pending in court of learned Judicial Magistrate, Chatra. 3. Learned counsel for petitioner submits that the petitioner happened to be the owner of the tractor in question and the allegations in the offence report is made that the sand was loaded on the said tractor. He further submits that however in the seizure list only tractor is shown and there is no sand disclosed in the seizure list. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.10 of the petition. 4. Learned State counsel opposes prayer and submits that in the offence report it has come that the sand was loaded. 5. Considering that the petitioner is owner and has got no criminal antecedent and in the seizure list, there is no sand shown and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, Chatra, in connection with Complaint Case No.487 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
