(AS NOW E.O APPOINTED TO THE TEMPLE IT IS BEING REPRESENTED BY INSPECTOR). ...RESPONDENT(S): 2 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue Writ of Direction more particularly in the nature of Writ of Mandamus questioning the action of respondents in unilaterally constituting temporary committees for the 6th respondent temple without involving the trust board as illegal, arbitrary, without jurisdiction, contrary to the provisions of the AP Charitable and Hindu Religious Act 30/1987 and also violates the provisions of article 14, 25 and 26 of the Constitution of India and apart from against the Principles Of Natural Justice and consequently direct the 6th respondents not to interfere with management of the respondent temple either by appointing unauthorized/temporary committees and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents not to interfere with management of Trust Board of the 6th respondent temple in the upcoming Kartika Aakadasi Kalyanam to be held on 01.11.2025, Jwala Thoranam to be held on 05.11.2025 and other affairs of the temple including appointment of unauthorized committees and to pass Counsel for the Petitioner: 1. GP FOR ENDOWMENTS The Court made the following: ORDER:- Heard Sri Mutyala Sobhanadri Naidu, learned counsel for the petitioner, Sri Naga Bhushanam, learned Assistant Government Pleader for Endowments appearing for the respondent Nos.1 to 5 and Sri Kappera Koteswara Rao, learned Standing Counsel appearing for the respondent No.6. 2. The grievance of the petitioner is against the proceedings of the 3rd respondent in unilaterally constituting temporary committees for the 6th respondent-temple, without involving the Trust Board. The petitioner 3 contends that he is the Chairman of the Trust Board of the 6th respondent-temple, the 3rd respondent, without involvement of the Trust Board, issued proceedings dated 20.09.2025, constituted “Festival Committee” to the 6th respondent-temple for conducting Devi Navaratri Mahotsavamulu for the period of 22.09.2025 to 02.10.2025. Challenging the said action of the 3rd respondent in constituting the temporary committees, the instant writ petition is filed. 3. When the matter was taken up for consideration, the learned Assistant Government Pleader for Endowments placed before the Court a copy of the instructions received by him in the case. A perusal of the same would reflect that the term of the previous Trust Board expired on 19.07.2023. Presently, there is no Trust Board in respect of the subject temple. Since no Executive Officer was appointed for the 6th respondent-temple to conduct the Devi Navaratri Mahotsavamulu, a Festival Committee was constituted to ensure the festival was conducted peacefully. It further reflects from the said instructions that the 3rd respondent, vide his proceedings dated 24.10.2025, appointed the Executive Officer as a single trustee for the administration of the 6th respondent-temple, since there is no Trust Board constituted for the subject temple. 4. Having regard to the above, the relief sought by the petitioner does not merit consideration. The written remarks of the 4th respondent are placed on record. The Writ Petition is accordingly disposed of.
