It is contended that the petitioner was appointed as Fair Price Shop Dealer in 2010, but on account of criminal charges framed against the petitioner, the petitioner was removed from the dealership of the Fair Price Shop. Pursuant to the said vacancy, notification, dated 06.12.2024 was issued for appointment of the Fair Price Shop Dealers by the respondent No.3. Since one of the ineligibility criteria is that the applicant should not have any criminal cases initiated against the petitioner nor convicted either under the provisions of the Essential Commodities Act or any other enactments. The petitioner has made a representation on
26.12.2024. The date for written examination was fixed as 26.12.2024. 5.
In that view of the matter, it is contended that the petitioner could not apply for the Fair Price Shop Dealership due to his incapacities. Instead he made a representation and seeks for disposal of the representation. The petitioner may have made a representation. With regard to the ineligibility criterion, no criminal proceedings should be pending against the petitioner. Having regard to the same, the petitioner cannot apply for the dealership, pending disposal of the said criminal case. 6. Learned Assistant Government Pleader for Civil Supplies submits that in pursuance to the notification, dated 06.12.2024, written examination was conducted and results were announced. The

process was completed and appointment orders have also been issued and the dealer was also appointed. In view of the same, considering the representation of the petitioner, at this stage would not arise. 8. With the above observation, the writ petition is dismissed.
