The petitioner has filed the present petition, praying for following relief:- “It is therefore prayed that this Hon'ble Court may kindly be pleased to quash the FIR No. 528/2025 dated 11/05/2025 lodged by Police Station Supela, charge sheet No. 327/2025 dated 22/05/2025 and criminal case No. RCC/21535/2025 registered under Section 296, 351(3) BNS, 2023 by the Hon'ble 'Chief Judicial Magistrate, District-Durg taking cognizance of the offence against the petitioner, the next hearing of which is on 04/09/2025, in the interest of justice.” 3. From perusal of the cause-title in the present petition, it transpires that the same is a defective one as the FIR has been lodged by one Kanjulal i.e. father-in-law of the complainant, whereas respondent No.2 is the husband of the complainant and as such, the counsel for the petitioner has drafted a vague and sketchy petition, in a casual manner and has wasted the precious time of the Court. 4. In view of the same, learned counsel for the petitioner tenders his apology and prays to withdraw the present petition, with liberty to file afresh appropriately. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate pleadings impleading the necessary parties, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government Special School for Visually 3 Handicapped Boys and Girls, Jashpur (C.G.), for wasting the precious time of the Court. 6. Learned Panel Lawyer appearing for respondents / State is present. 7. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
