Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "I. to issue a writ, order or direction in the nature mandamus, direct the respondent no. 2/ Commissioner Varanasi, Division Varanasi to decide the Appeal Case No. 1464/2023 (Compturized Case No. C202314000001464) "Harihar Prasad Vs. Narendra Kumar & others" Under Section 207 of U.P. Revenue Code 2006, within stipulated period of time which may be fixed by this Hon'ble Court. II. to issue a writ, order or direction in the nature mandamus to direct the respondent authorities not to disposes from his land in dispute i.e. Arazi No. 2998 area 0.032 Dismial, Arazi No. 3791 area 7 Dismal, Arazi No. 3793 area 9 Dismal & Gata No. 3795 area 3 Dismal situated in Mauja & Post-Kathiraon, Pargana- Pandrah, Tehsil- Pindra, District- Varanasi, during pendency of the appeal before the respondent no. 2." 3. Contention of the learned counsel for the petitioner is that the aforementioned appeal is pending since 2023 before respondent no.2 for adjudication. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the respondent No. 2 to consider and decide the aforementioned appeal of the petitioner, in accordance with law, expeditiously, preferably within a period of four months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
