[2025:RJ-JP:33923] (2 of 2) [CW-12762/2025] 2. Learned counsel for the petitioner submits that, on earlier occasion also with regard to the same grievance, the petitioner approached this Court by way of filing S.B. Civil Writ Petition No.14411/2023 and the same was disposed of by this Court on 16.11.2023 directing the respondents to decide the representation of the petitioner after affording due opportunity of hearing to all the affected parties. Learned counsel submits that pursuant to the aforesaid order, the needful exercise was done by the respondents and encroachment from the subject land was removed, but some time thereafter, again encroachment has been raised by the encroachers for which again a complaint has been filed in the office of the respondents, but inspite of passing of considerable time, till date the said complaint submitted by the petitioner has not been decided, hence, interference of this Court is warranted. 3. Considering the aforesaid submissions made by counsel for the petitioner and looking to the fact that complaint submitted by the petitioner is still pending before the authorities concerned for its adjudication on its merits, this Court deems it just and proper to dispose of the writ petition with the expectation from the respondents to decide the complaint submitted by the petitioner strictly in accordance with law after affording due opportunity of hearing to all the respective parties, expeditiously as early as possible, preferably within a period of three months from the date of receipt of certified copy of this order. 4.
