Srivastava, Advocate ---- 04/12.12.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Saria P.S. Case No.80 of 2025, for the alleged offences registered under Sections 329(3), 126(2), 115(2), 118(1), 109(1), 303(2), 324(3), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Giridih. 3. Learned counsel appearing for the petitioner submits that false allegations are made against the petitioner and due to land dispute and erection of wall altercation took place. She further submits that the allegation of assault is not there against the petitioner and the allegation of assault is there against one Ashok Mandal. She then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition. She next submits that in identical situation co-accused persons have 2025:JHHC:37402 --2-- A.B.A. No. 7099 of 2025 already been granted anticipatory bail in ABA Nos.6257 of 2025 and 5273 of 2025. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of assault against all the accused persons. 5. Considering that so far the petitioner is concerned there are general and omnibus allegation and the direct allegation of assault is there against one Ashok Mandal and the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition and in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid ABA, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Giridih in connection Saria P.S. Case No.80 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 12.12.2025 Sangam/
